1. Agreement

By downloading or using the Baba app (the “App”) or the website readbaba.com (the “Website”), together the “Service”, you agree to these Terms. If you do not agree, please do not use the Service. You must be at least 13 years old; if you are under 18, a parent or guardian must agree on your behalf.

2. What the Service is

Baba is a read-only app for the Ukrainian diaspora. It brings together:

Headlines and excerpts from Ukrainian and international newsrooms, with links to the full articles
Political, war and public data from open sources
Orthodox calendar data, scripture, liturgical texts and audio, and church livestreams
Ukrainian cultural content, including recipes, crafts, figures and history
Live radio, church livestreams and podcasts from their publishers
A directory of Ukrainian parishes and community organisations

Baba does not publish original reporting. Full articles open on the publisher’s own website.

3. Acceptable use

There are no accounts, comments, messages or other user posts. When using the Service you agree not to:

Reverse engineer or attempt to gain unauthorised access to the App, our servers or interfaces
Use bots, scrapers or other automated means beyond ordinary personal use
Redistribute or commercially exploit content made available through the Service
Use the Service unlawfully or interfere with its operation

4. Content and intellectual property

Third-party content: Articles, images, audio and video belong to their publishers and rights holders. Baba shows headlines, short excerpts and metadata and links to the original. Streams are provided by their publishers, and their availability can change at any time.
Baba: The Baba name, logo and the design of the App and Website belong to Baba. Please ask before using them.
Open source: Parts of the Service use open-source software under its own licences.

5. Accuracy and sensitive content

We choose sources carefully, but we cannot guarantee the accuracy, completeness or timeliness of third-party content, and including a source is not an endorsement of every view it publishes.

The Service covers Russia’s war against Ukraine. Graphic material is hidden and sensitive images blurred by default; please use discretion. Faith content is provided for devotional and informational purposes and is not pastoral counsel.

6. Editorial policy

Baba includes only sources that meet our standards of journalistic integrity. We exclude:

Russian state-controlled media
Sources that promote or justify aggression against Ukraine
Outlets known for systematic disinformation
Extremist or hate-promoting sources

Decisions about sources are ours alone and may change over time.

7. Purchases

Baba is a one-time purchase through the App Store. Payment, refunds and Family Sharing are handled by Apple under its own terms.

8. Privacy

Our Privacy Policy explains how the Service handles information and forms part of these Terms.

9. Availability and changes

We work to keep the Service available, but cannot promise uninterrupted access. We may add, change or remove features, sources and stations, and perform maintenance, at any time.

10. Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND ACCURACY.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BABA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICE OR ANY CONTENT OBTAINED THROUGH IT. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE APP OR FIFTY US DOLLARS.

Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.

12. Indemnity

You agree to indemnify Baba against claims arising from your breach of these Terms or misuse of the Service.

13. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. We will first try to resolve any dispute informally; if that fails, it will be resolved by binding arbitration under the rules of the American Arbitration Association, in English.

14. General

If any part of these Terms is unenforceable, the rest remains in effect. We may update these Terms and will change the date above when we do; continuing to use the Service means you accept the update. These Terms are written in English and Ukrainian; if they differ, the English version prevails.
