Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Baba mobile application (“App”) or accessing the Baba website (“Website”), collectively referred to as the “Service,” you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

These Terms constitute a legally binding agreement between you and Baba App (“we,” “us,” or “our”). You must be at least 13 years of age to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Description of the Service

Baba is a read-only news aggregation application designed primarily for the Ukrainian diaspora. The Service aggregates, curates, and presents content from third-party sources including, but not limited to:

  • News articles and headlines from trusted Ukrainian and international newsrooms
  • Political analysis and parliamentary updates
  • War and conflict reporting
  • Orthodox Christian faith content, including liturgical calendar data, prayers, saints, and scripture
  • Cultural articles about Ukrainian art, literature, music, and traditions
  • Podcast directories and audio content links

The Service does not publish original reporting. We aggregate metadata, excerpts, and links to original publisher content. Full articles are accessed via the original publisher's website through in-app web views or external links.

3. User Conduct and Acceptable Use

Baba is a consumption-only platform. There are no user accounts, user-generated content features, comments, messaging, profiles, or social networking functionality. By using the Service, you agree:

  • Not to reverse engineer, decompile, or disassemble any part of the App or its backend systems
  • Not to attempt to gain unauthorized access to our servers, APIs, or administrative interfaces
  • Not to use automated tools, bots, scrapers, or crawlers to access the Service beyond normal use
  • Not to redistribute, republish, or commercially exploit content aggregated by the Service
  • Not to use the Service for any unlawful purpose or in violation of any applicable laws
  • Not to interfere with or disrupt the integrity or performance of the Service

4. Intellectual Property

Third-party content: All news articles, images, videos, and other media accessible through the Service are the intellectual property of their respective publishers and rights holders. Baba does not claim ownership of any third-party content. We display headlines, excerpts, and metadata under fair use principles and link users to the original source for the complete content.

Baba trademarks: The Baba name, logo, tryzub design elements, and the visual design of the application are the property of Baba App. You may not use our trademarks without prior written permission.

Open-source licenses: Certain components of the Service may incorporate open-source software, which is subject to its own licensing terms.

5. Content Disclaimer

The content displayed in the Service is sourced from third-party publishers. While we curate our source list carefully and exclude sources known for misinformation or propaganda, we do not:

  • Guarantee the accuracy, completeness, or timeliness of any content
  • Endorse the views, opinions, or editorial positions expressed by any source
  • Verify every individual article or piece of content
  • Assume responsibility for errors or omissions in third-party reporting

Sensitive content: The Service may display content related to armed conflict, war casualties, and other sensitive topics. We implement content warnings and sensitivity ratings where appropriate, but users should exercise discretion when reading war-related content.

Faith content: Religious content, including Orthodox calendar data, prayers, and scripture readings, is sourced from established liturgical databases and represents the Orthodox Christian tradition. It is provided for informational and devotional purposes only and does not constitute religious instruction or pastoral counsel.

6. Source Curation Policy

We maintain a strict editorial policy regarding content sources. Our curated whitelist includes only sources that meet our criteria for journalistic integrity and reliability. We explicitly exclude:

  • Russian state-controlled media outlets
  • Sources that promote pro-war propaganda or justify military aggression against Ukraine
  • Outlets known for systematic misinformation or disinformation
  • Extremist, hate-promoting, or otherwise harmful sources

Source inclusion and exclusion decisions are made at our sole discretion. We assign trust tiers (Tier 1 through Tier 3) to sources based on reliability, editorial standards, and track record. Content from lower-tier sources may receive reduced visibility in the feed.

7. Privacy and Data

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully.

8. Push Notifications

The Service may send push notifications for breaking news, daily digests, and other updates if you grant notification permissions. You can manage or disable notifications at any time through your device settings or within the App's Settings section.

9. Availability and Modifications

We strive to maintain continuous availability of the Service but do not guarantee uninterrupted access. We reserve the right to:

  • Modify, suspend, or discontinue any feature of the Service at any time
  • Perform maintenance that may temporarily affect availability
  • Change the content sources included in the aggregation at our discretion
  • Update the App to improve performance, fix bugs, or add features

We will make reasonable efforts to provide notice of significant changes but are not obligated to do so.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY CONTENT WILL BE ACCURATE OR RELIABLE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BABA APP, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to, use of, or inability to use the Service
  • Any content obtained from or through the Service
  • Unauthorized access, use, or alteration of your data
  • Any third-party conduct or content on the Service

Our total aggregate liability for all claims related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or fifty dollars ($50.00 USD), whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless Baba App and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms or your use of the Service.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in English.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or Website. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
